Questions We Often Hear from Attorneys

How does Prosperity Planning work with attorneys?

We work alongside attorneys to help provide financial clarity for clients navigating complex decisions before, during, and after divorce. Our role is to complement the legal process by providing objective financial analysis, helping clients understand the long-term financial implications of today's decisions, and supporting informed financial decision-making throughout the divorce process.

Do you analyze marital lifestyle?

Yes. We combine financial data with real-life context to understand what life looked like during the marriage and what it realistically costs to maintain.

Do you take a thorough look at financial discovery for missing information?

Yes. We review financial documents, such as tax returns, business tax returns, account statements, and other financial records, to help clients better understand their income, expenses, and overall financial picture.

As part of that review, we identify expenses that may actually be personal, helping create a clearer picture of income and lifestyle that can impact support calculations.

Can you help evaluate pensions and other complex assets?

Yes. We provide analysis to estimate the present value of future pension benefits to support planning discussions and help determine the marital portion.

We also provide guidance on valuation and tax issues for businesses, private investments, stock compensation, and other complex assets. For more complex cases, we may recommend working alongside a certified valuation specialist.

Do you trace assets acquired before marriage?

Yes. We help gather and organize documentation to identify separate property and provide support if assets have been mixed with marital funds.

Do you help with future cash flow and post-divorce planning?

Yes. We build forward-looking budgets and "what-if" scenarios so clients can feel more confident about the road ahead.

Divorce often brings up many important financial questions, and we're here to help clients think through topics such as:

  • Can I afford to keep the home?
  • Will I be financially secure with this settlement?
  • Do I need to continue working or return to work?
  • How is Social Security affected?
  • What are my health insurance options?
  • How will my tax situation change?

Do you provide tax planning?

Yes. We offer practical guidance on tax considerations, including which tax rates may be appropriate when valuing assets, how filing jointly versus separately may impact outcomes, and how different settlement decisions could affect future taxes.

What services does Prosperity Planning not provide?

While we provide comprehensive financial planning and analysis, there are certain services outside our scope.

  • We do not draft QDROs.
  • We do not prepare tax returns.
  • We do not serve as a financial neutral. We work with one spouse to provide personalized guidance and avoid conflicts of interest.

What can clients expect when working with Prosperity Planning during a divorce?

Clients are encouraged to engage us as early in the divorce process as possible and typically work with us through the completion of their case. This allows us to provide ongoing financial analysis, evaluate settlement options as circumstances evolve, and help clients prepare for the financial decisions that follow.

Divorce financial planning engagements typically begin with a $2,500 upfront fee, followed by $500 per month while the divorce is ongoing. Additional hourly fees may apply for services such as participation in mediation or expert testimony. We discuss fees and the scope of services upfront, so clients know what to expect before moving forward.

While the divorce financial planning engagement concludes once the divorce process is complete, many clients choose to continue working with Prosperity Planning for ongoing financial planning, retirement planning, and investment management. If ongoing planning is a good fit, we'll discuss those options separately based on each client's needs.
